When a Window Needs Fall Protection (IRC R312.2)

Section R312 of the International Residential Code is titled "Guards and window fall protection," and the two halves of it are usually discussed separately. The guard half is familiar: a deck more than 30 inches above grade needs one.
The window half is less familiar, applies to a surprisingly narrow set of windows, and then — on the windows where it does apply — runs directly into another requirement that wants the opposite thing.
Two measurements, two different surfaces
The trigger is in Section R312.2.1, and it is the part most worth getting right, because a misreading here produces either an unnecessary expense or an unprotected window.
In dwelling units, fall protection is required where both of the following are true of the same operable window:
- the bottom of the clear opening is located less than 24 inches above the finished floor, and
- that opening is greater than 72 inches above the finished grade or other surface below on the exterior of the building.
Those two measurements are taken from two different surfaces, one inside and one outside, and they have to be satisfied together.

The practical consequence is that this is essentially a second-storey and above requirement. A low window on a ground floor almost never has 72 inches of drop beneath it. A high window upstairs fails the first condition. The rule catches the window that is low relative to the room it is in and high relative to the ground it overlooks — which is exactly the window a small child can reach and fall a long way from.
"Bottom of the clear opening" is not the sill
This is the detail that published summaries most often get wrong, and it is worth a paragraph because it changes the measurement on real windows.
The code measures to the bottom of the clear opening: the lowest point of the actual opening a body could pass through. The sill is a frame member, and on several common window types it sits lower than the clear opening does. A single-hung window whose lower sash slides upward has a clear opening whose bottom is determined by the sash position, not by the sill. Measure to the sill and you will usually get a smaller number than the code asks for, and a smaller number is the one that triggers the requirement.
The commentary itself slips into calling it sill height in places, which is probably where the confusion started. The operative text does not.
The two ways to comply
Where both conditions are met, the window must comply with one of the following:
- The openings will not allow a 4-inch-diameter sphere to pass through where the openings are in their largest opened position. Some awning, hopper and casement units achieve this with their own control arms or vent limiters.
- Window opening control devices or fall prevention devices that comply with ASTM F2090.
That is a closed list of two. It is worth saying plainly what is not on it: an insect screen is not fall protection. Screens are not designed, tested or rated to restrain a person's weight, and the belief that a screen is a barrier is behind a meaningful share of the falls this section exists to address.
Where the rule collides with the egress rule
Here is the part that makes this interesting rather than merely dimensional.
An upstairs bedroom window is frequently required to be two things at once. It must satisfy window fall protection under R312.2 if it meets the two triggers. It must also serve as an emergency escape and rescue opening, with a minimum net clear opening area, a minimum clear height and a minimum clear width — and a sill not more than 44 inches above the finished floor.
Those requirements want opposite things. Fall protection wants the window restricted to less than four inches. Escape wants it wide open, operable from inside without keys, tools or special knowledge.
Section R312.2.2 resolves it, and the resolution is specific. Where an operable window serves as an emergency escape and rescue opening, the window opening control device or fall prevention device, after operation to release it and allow the window to fully open, shall not reduce the net clear opening area of the window unit below what the escape provisions require.
So the sequence the code contemplates is: restricted in normal use, released by an occupant, fully open, full escape opening still available.
This is precisely what a compliant WOCD does. It limits the sash to less than four inches in ordinary operation, releases from the inside, and resets automatically when the sash is closed again so that protection does not depend on anyone remembering to re-engage it. ASTM F2090 is titled for window fall prevention devices with emergency escape release mechanisms, and is written for devices within 75 feet of grade. Fall prevention devices such as window guards have to satisfy the same logic — releasable or removable from the interior so the window can still be used to escape.
It also explains why the sphere option is the wrong choice on a bedroom window. A window permanently limited to a four-inch opening complies with fall protection and cannot be escaped through. The commentary says as much: that option should be used only on openings not required or designated as emergency escape and rescue.
Why 24 inches
The number is not arbitrary and the reasoning is worth knowing, because it tells you what the rule is actually protecting against.
A study commissioned in connection with this provision reported the standing centre of gravity of children aged 2 to 3.5 years at 24.1 inches — 50th percentile 22.2 inches — and of children aged 3.5 to 4.5 years at 25.2 inches, 50th percentile 23.6 inches. A sill at or above roughly that height makes it materially harder for a young child to climb up and topple over.
For contrast, the International Building Code requires a minimum sill height of 36 inches in the buildings it covers. The 24-inch figure is the residential number, not a universal one.
Where this belongs in a job
Every measurement above can be taken before anything is ordered, and none of it can be taken from a photograph or inferred from a quote that says "replace 6 windows, upstairs."
On a window replacement, fall protection changes what you buy, not just how it is fitted. A sash ordered without a control device for an opening that needs one is a return and a delay, and not every frame will accept an approved device retrofitted afterwards. Whether the requirement is triggered on a replacement in an existing house depends on the jurisdiction and on how the work is classified, which is the authority having jurisdiction's answer rather than something the model text settles by itself.
A scope of work that will not produce a surprise names, for each opening: the measured height of the bottom of the clear opening above the finished floor, the drop to grade outside, whether the window is designated as an emergency escape and rescue opening, and — if fall protection applies — which of the two compliance routes is being used.
