Overlays exist because some regulatory concerns follow geography rather than land use. The appearance of a historic streetscape, the fire behaviour of a brush-covered hillside and the wind exposure of a coastline are all properties of a location, not of what somebody does there. A city cannot address them through use zoning, so it draws a boundary and writes rules that apply inside it.

For solar, the operative consequence is short: a design can satisfy every applicable code and still be refused, because the overlay reviewer is applying a different test than the code official is.

The three that matter for residential solar

Historic and conservation districts

The test here is appearance and reversibility, not energy. Reviewers are generally asking whether the installation is visible from the public right of way, whether it alters the character of a protected roof, and whether it could be removed later without permanent damage.

The outcomes that recur:

  • Placement restrictions. Modules confined to rear-facing slopes, or to slopes not visible from the street. On a house whose only good solar orientation faces the street, this can halve a system or end a project.
  • Finish and detailing requirements. Black frames and rails, no visible conduit, equipment concealed or relocated away from a street elevation.
  • A separate approval. Frequently a certificate or determination from a review commission, obtained before or alongside the building permit rather than instead of it.

Several states have legislated to limit how far such restrictions can reach, and the drafting varies considerably between them. That variation is genuine, so the specific jurisdiction is the only reliable source on what its commission may and may not require.

Wildland-urban interface areas

A wildland-urban interface designation brings fire considerations forward and usually brings a fire authority in as a reviewer with independent authority.

What changes in practice:

  • Access pathways and setbacks are applied strictly. The roof clearances that exist so a crew can work a fire are enforced as written rather than negotiated against production.
  • Ignition resistance can extend beyond the roof covering. Requirements can reach materials and the treatment of the area around ground-mounted equipment.
  • Equipment siting is constrained. Where inverters, disconnects and storage may be located can be narrower than elsewhere in the same city, which on a storage project can reach the critical load panel and the run between it and the main service equipment.
  • There is a separate inspection. Fire authorities frequently inspect on their own visit rather than commenting through the building department, which adds a step to the schedule.

Coastal and high-wind zones

This one lands on the engineering rather than on the appearance.

A higher design wind speed increases the uplift the array and its attachments must resist. The design response is more attachment points at closer spacing, heavier hardware, and larger setbacks from roof edges and corners where uplift concentrates. That is a straightforward engineering exercise, and it is also a materially different bill of materials and a longer install.

The documentation burden rises with it. Reviewers in these areas commonly want site-specific structural calculations rather than a generic letter, which is a different product from an engineer and a different lead time. Some jurisdictions additionally maintain their own product approval or acceptance process for assemblies used in wind-borne debris regions, meaning the racking has to be on a list before it can be used. Flood-hazard overlays are worth a sentence in the same breath. They rarely affect a roof array, but they can dictate the elevation of ground-level equipment, which is a real constraint on a ground mount or on where an inverter and storage may sit. That lands hardest on the designs that were pushed to the ground in the first place, which is frequently the case on a manufactured home.

The schedule column is where the damage concentrates. A design review commission that convenes once a month is not a two-week delay, it is a delay bounded by a calendar nobody on the project controls. How to find one before it finds you

An overlay is a property of the mapped parcel, not of the mailing address. That is precisely why it is missed: everything about a lead is an address, and nothing about an address reveals the layer over it.

Three checks, in increasing order of cost:

  1. The jurisdiction's public mapping service. Most publish zoning and overlay layers. This is a search on a parcel number and it takes a minute.
  2. The parcel or assessor record. Establishes the parcel and its base zoning, and confirms which jurisdiction is actually the AHJ, which is separately worth doing because an address with a city mailing address can sit in unincorporated county territory.
  3. The building department, directly. Where the mapping is unclear or absent, they will answer. One phone call against one review cycle is not a close decision.

The site survey is the natural place to have already done this, because the surveyor is the first person to look at the property as a location rather than as an address. A proposal priced from aerial imagery alone cannot catch an overlay, since imagery shows the roof and shows nothing about the regulation over it.

Who owns this in a split model

In a model where one organisation sells and another fulfils, the party that discovers the overlay is not the party that priced the job. That division works as long as two things hold: the address is captured accurately at qualification, and the design team checks the parcel before drawing anything.

Where it breaks, the consequence lands on the sold price regardless of who missed it. An overlay found after contract is either a redesign, an adder somebody absorbs, or a cancellation. Found before, it is a constraint the design accommodates and the proposal reflects.
